1. PREAMBLE, CORPORATE COMMITMENT & DUAL-PROTECTION DOCTRINE

1.1 The InViGiL Privacy Standard

FG MEDIA AND SAFETY TECHNOLOGIES PRIVATE LIMITED ("FG Media," "Company," "we," "us," or "our") operates InViGiL: The Invincible Super Power ("InViGiL," "Platform," "Ecosystem," or "Application"). In an era where legacy technology conglomerates, mobile hardware manufacturers, and social media networks commoditize user data through opaque algorithmic tracking, InViGiL establishes a new global benchmark for Verifiable Privacy, Cryptographic Sovereignty, and Lawful Data Utility.

1.2 The Dual-Protection Mandate (Protecting Both the User and the Enterprise)

This Privacy Policy is engineered as a mutually protective legal covenant:

  • Protection of the User (Data Principal / Data Subject): InViGiL rigorously safeguards your personal identity, reputation, private communications, and biometric integrity against unauthorized third-party exploitation, cyber-espionage, deepfake manipulation, and unlawful surveillance. We collect, process, and retain your data strictly for fair, transparent, and lawful purposes that empower your digital and physical safety, as permitted by the law of the land in your jurisdiction.
  • Protection of the Enterprise (Data Fiduciary / Controller & Leadership): Simultaneously, this Policy establishes an unassailable legal, technical, professional, and financial shield around InViGiL, FG MEDIA AND SAFETY TECHNOLOGIES PRIVATE LIMITED, FG Media Group, and their respective Founders, Owners, Ultimate Beneficial Owners (UBOs), Directors, Officers, Editors, Employees, Legal Representatives, Investigators, and Associates. By accessing the Platform across any device (Mobile, Desktop, Smart TV, or Web), you explicitly acknowledge that FG Media operates strictly within lawful statutory mandates and intermediary safe-harbor protections. FG Media shall never be held legally, professionally, or financially liable for user-initiated actions, third-party criminal acts, force majeure events, or regulatory conflicts arising from your autonomous use of the Platform.

2. MULTI-PLATFORM ARCHITECTURAL SCOPE (MOBILE, DESKTOP, SMART TV & SOFTWARE)

This Privacy Policy governs data ingestion, processing, transmission, and storage across the entire multi-device InViGiL synchronization architecture:

  • Mobile Applications (Android & iOS): Governs permissions related to camera/lens modules (ViERA Lens), microphone arrays, GPS/GLONASS/NavIC spatial telemetry (MAAPit), biometric hardware enclaves, contact book hashing (MUChat), background SOS distress triggers, and mobile push notification tokens.
  • Desktop & Web Applications (Windows, macOS, Linux, Browsers): Governs local cache storage, WebRTC peer-to-peer communication streams, cryptographic session tokens, hardware security keys (FIDO2/Passkeys), enterprise dashboard analytics, and document/media upload pipelines.

4. LAWFUL BASES FOR PROCESSING & GLOBAL CONSENT ARCHITECTURE

InViGiL processes personal data strictly in accordance with the prevailing statutory frameworks of the user's jurisdiction:

  • Explicit, Granular, and Informed Consent: Before collecting sensitive personal data (such as Biometrics for ViERA, real-time GPS for SOS, or forensic files for IRN investigations), InViGiL obtains your clear, affirmative opt-in consent. You may manage or withdraw non-essential consents via the in-app Privacy & Sovereignty Center.
  • Performance of a Binding Contract: Processing necessary to deliver the core functionalities requested by you under our Terms of Service (e.g., routing MUChat messages, rendering EPapers on Smart TVs, processing Marketplace transactions).
  • Compliance with Statutory & Legal Obligations: Processing mandated by sovereign laws, including tax reporting, anti-terrorism financing checks, cybersecurity incident logging (e.g., CERT-In mandates), and lawful court orders or police subpoenas.
  • Protection of Vital Interests & Public Safety: Processing executed during an active SOS Emergency trigger, imminent threat to human life, child safety protection (CSAM eradication), or verified Whistleblower emergency disclosures.
  • Legitimate Interests & Platform Security (Where Recognised by Law): Processing strictly necessary for network security, fraud prevention, algorithmic Fact-Score verification, C2PA cryptographic watermarking, and defending FG Media Group in civil or criminal litigation.

5. PROPRIETARY AI GOVERNANCE: ViERA ENGINE, C2PA PROVENANCE & DISTRIBUTED INFRASTRUCTURE

Unlike competing platforms that harvest user data to build generalized commercial advertising profiles sold to third-party brokers, InViGiL's AI architecture is built on User-Centric Sovereignty and Verifiable Truth:

  • Distributed Compute Security (Ray & Kubernetes Clusters): Data authorized for AI processing is ingested into isolated, high-security distributed Ray and Kubernetes compute nodes. Data is encrypted in transit (TLS 1.3+) and at rest (AES-256 / ChaCha20-Poly1305).
  • ViERA Digital Persona Boundaries: Your ViERA digital clone operates under strict cryptographic access controls. Biometric templates used to animate or train your ViERA actor are stored as irreversible mathematical vector representations—not raw, downloadable identity kits—preventing external extraction or unauthorized cloning.
  • C2PA Cryptographic Provenance & SGI Labeling: To protect user reputation against malicious deepfakes, media captured via the ViERA Lens or published through the ViERA News Room is embedded with tamper-evident C2PA (Coalition for Content Provenance and Authenticity) metadata and cryptographic watermarks. Synthetically Generated Information (SGI) is strictly labeled in compliance with global AI transparency mandates.
  • Zero Third-Party Data Brokerage: FG Media Group does not sell, rent, or auction your personal biometric data or private MUChat communications to external third-party data brokers.

6. COMPREHENSIVE MULTI-JURISDICTIONAL LEGAL COMPLIANCE MATRIX

InViGiL is architected to comply with—and exceed—the data protection, intermediary, and cybersecurity statutes of every sovereign region in which it operates. However, in all cross-border interpretations, the overarching legal shield protecting FG MEDIA AND SAFETY TECHNOLOGIES PRIVATE LIMITED and the exclusive jurisdictional anchor of Bengaluru, Karnataka, India, shall remain paramount to the fullest extent permitted by international law.

6.1 Republic of India (Primary Jurisdictional Anchor)

  • Digital Personal Data Protection Act, 2023 (DPDP Act) & Rules: FG Media acts as a compliant Data Fiduciary. 7. SPECIFIC PRIVACY DISCLOSURES FOR CORE InViGiL MODULES

To ensure absolute transparency superior to any competing application, users are explicitly informed of how data operates within specialized InViGiL features:

  • Global Investigations, Verification & IRN System: When a user initiates an Investigation Request Number (IRN) for background checks, matrimonial verification, land/vehicle audits, or legal defense, the user explicitly and irrevocably authorizes FG Media's internal verification division and accredited field investigators to access, cross-reference, and analyze relevant digital footprints, submitted CCTV feeds, communication logs, and public/authorized government records. Conversely, if you are the subject of a lawful due-diligence or journalistic inquiry conducted under applicable law, publicly available data and lawfully obtained verification records may be processed to generate objective Trust Ratings and Fact Scores.
  • SOS Emergency & Physical Security Hiring: Triggering the SOS Button overrides standard location-privacy masking. It immediately broadcasts your live GPS coordinates, device battery state, emergency contact list, and live ambient audio/video stream to local Police authorities and the InViGiL Rapid Response Center.
  • Whistleblower Portal (Zero-Knowledge Anonymity Option): Users submitting high-risk public-interest disclosures via the Whistleblower Portal may opt for cryptographic metadata stripping, wherein EXIF data, IP routing logs, and device identifiers are scrubbed prior to publication to protect the whistleblower's physical safety, subject only to supreme national security laws.
  • Public Media, HIT News Network, Teasers, Jalsa & Marketplace: Content posted to public feeds (Stories, Teasers, Posters, Jalsa Podcasts, EPapers, Live TV, Classifieds, Matrimonial Profiles, and Job Boards) is public by design. By publishing to these modules, you waive expectations of private confidentiality over that specific content and grant FG Media Group a worldwide, perpetual, royalty-free license to index, distribute, Fact-Score, and monetize such content.

8. DATA SHARING, THIRD-PARTY ECOSYSTEM & LAW ENFORCEMENT PROTOCOLS

InViGiL restricts external data sharing to strictly controlled, legally vetted channels:

  • Internal Corporate Group Sharing: Data may be shared securely across FG MEDIA AND SAFETY TECHNOLOGIES PRIVATE LIMITED, FG Media Group, and subsidiary media entities (including HIT News Network, Happy India Times, AP MEDIA, and Kurukshetra) for unified authentication, editorial verification, and security operations.
  • Authorized Infrastructure & Payment Processors: We share necessary technical tokens with PCI-DSS compliant payment gateways, telecom DLT/SMS gateways, and cloud compute providers operating under strict Data Processing Agreements (DPAs) that prohibit independent use of your data.
  • Accredited Field Investigators & Security Personnel: When you book an IRN investigation or on-demand physical security/bodyguard deployment, relevant operational details are shared under strict Non-Disclosure Agreements (NDAs) with assigned personnel to execute your request.
  • Law Enforcement, Judicial & Sovereign Requests: FG Media respects the rule of law globally. We disclose account records or telemetry to law enforcement agencies, courts, or statutory bodies only upon receipt of a legally valid, jurisdictionally binding warrant, subpoena, court order, or statutory emergency directive (such as orders issued under Section 69/79 of the Indian IT Act or equivalent verified mutual legal assistance treaties - MLATs). Where an user herself/himself initiates an IRN defense request, the user authorizes FG Media to proactively compile and present digital evidence to law enforcement or courts to protect the user's legal interests.

9. CRYPTOGRAPHIC SECURITY ARCHITECTURE, RETENTION & DATA DELETION

9.1 Defense-in-Depth Technical Safeguards

InViGiL employs enterprise-grade security measures exceeding industry standards:

End-to-End & Transport Layer Encryption: TLS 1.3 for all network transit; AES-256-GCM and cryptographic key-exchange protocols for MUChat and Vault storage.

  • Zero-Trust Internal Access: Role-Based Access Control (RBAC), Multi-Factor Authentication (MFA), hardware passkey enforcement, and immutable audit logging for all FG Media engineers and compliance officers.
  • Anti-Scraping & DDoS Mitigation: Automated Web Application Firewalls (WAF) and behavioral bot-detection protecting user profiles from unauthorized external AI scraping.

9.2 Data Retention Schedule & Deletion Rights

  • Active Accounts: Personal data is retained for as long as your InViGiL account remains active to provide seamless multi-device synchronization.
  • Account Deletion & Erasure: Users may initiate permanent account deletion directly within the mobile, desktop, or web application settings (satisfying Apple App Store and Google Play Store user-initiated deletion mandates). Upon verification, public profile data is removed immediately, and backend personal data is purged or irreversibly anonymized within 30 to 90 days.
  • Mandatory Statutory & Legal Hold Exceptions: Notwithstanding a user deletion request, FG Media is legally mandated and authorized to retain specific data logs where required for:
  • Mandatory 180-day cybersecurity log retention under Indian CERT-In directions;
  • Active or reasonably anticipated IRN Investigations, civil litigation, criminal inquiries, or subpoena holds;
  • Financial, wallet, and tax audit records (retained for 7 to 8 years under Indian Income Tax / GST laws and global AML statutes);
  • Permanent cryptographic blacklisting hashes of accounts terminated for severe violations (e.g., CSAM, terrorism, financial fraud) to prevent re-registration.
